The pandemic forced lawyers to accelerate a trend to take depositions of expert witnesses remotely. Before the pandemic, lawyers did so when court rules permitted remote depositions and the cost of traveling to the expert’s location (or paying the expert to travel) was prohibitive.
During the pandemic, lawyers became more comfortable with remote deposition testimony. While remote depositions can be problematic, lawyers have generally worked out the kinks in the system and learned how to question expert witnesses on camera.
